PART I: DIGITAL ACCESSIBILITY & INCLUSIONARY GOVERNANCE

 

1. Statement of Intent & Standards Commitment

BuildPod LLC (“the Company”) recognizes that digital accessibility is a core pillar of professional infrastructure. We are committed to ensuring that our digital presence is as high-performance and accessible as our physical micro-factories. We proactively design, develop, and maintain our platform—www.buildpodllc.com—to conform with the Web Content Accessibility Guidelines (WCAG) 2.2 Level AA standards.

2. Technical Accessibility Architecture

To ensure an inclusive experience for users with sight, hearing, and motor impairments, we have engineered the following features into our site architecture:

  • Semantic Markup & Structure: We utilize a rigid HTML5 hierarchy (e.g., <h1> through <h6>) and WAI-ARIA (Accessible Rich Internet Applications) landmarks to provide screen readers with a logical path through our technical specifications.

  • Advanced Keyboard Navigation: The Site is fully operable via keyboard interface. This includes “Skip to Content” links, visible focus indicators, and the elimination of “keyboard traps” to ensure motor-impaired users can navigate without a mouse.

  • Visual Data Integrity: We enforce a minimum color contrast ratio of 4.5:1 for all text and interactive elements. All non-text content (engineering renders, diagrams, and icons) is outfitted with descriptive Alternative Text (Alt-Text).

  • Responsive Typography: Users may scale text up to 200% via browser zoom without loss of Site functionality or disruption of the industrial logic layouts.

  • Form Governance: All input fields in our Pain Audit and Investor Portals utilize explicit <label> tags and provide real-time, screen-reader-compatible error identification and remediation instructions.

3. Continuous Audit & Remediation

Accessibility is an iterative engineering process. BuildPod LLC employs a multi-layered testing protocol:

  • Automated Telemetry: Monthly scans for WCAG 2.2 compliance errors.

  • Manual Evaluation: Periodic testing using assistive technologies, including NVDA, JAWS, and VoiceOver.

  • Third-Party Integration: We vet all third-party widgets and logic (e.g., Siemens-related embeds) for accessibility compliance prior to deployment.

PART II: MASTER TERMS OF PLATFORM GOVERNANCE (TOS)

 

1. Contractual Acceptance

These Terms of Service (“Terms”) constitute a legally binding contract between you (“User,” “you,” or “Partner”) and BuildPod LLC (“the Company,” “we,” “us,” or “our”). By accessing the Site or engaging with our Alpha Launch Reservation System, you affirm that you have the legal capacity to enter into this agreement and agree to be bound by its provisions.

2. Eligibility & Representation

By utilizing this Site, you represent and warrant that:

  • You are at least 18 years of age.

  • All data provided via the Pain Audit or Investor Hub is accurate, non-fraudulent, and current.

  • Your use of the platform is for legitimate professional, residential, or investment purposes and does not violate any local, state, or federal regulations.

3. Intellectual Property & Proprietary Industrial Logic

The BuildPod Site and its entire contents are the exclusive proprietary property of BuildPod LLC.

  • Protected Assets: This includes, but is not limited to, the “Micro-Factory” architectural concept, the Siemens-powered logic frameworks, UL-Certified electrical backbones, the Alpha Series design language, and the proprietary Pain Audit methodology.

  • Restricted Acts: No user may copy, reverse-engineer, "scrape," or decompile any portion of our Site logic or technical specifications. Any unauthorized reproduction of our high-resolution renders or engineering text for commercial gain is a violation of U.S. Trademark and Copyright law.

4. Prohibited Conduct & Platform Integrity

You are expressly prohibited from:

  • Data Harvesting: Using automated systems (bots, spiders, or AI scrapers) to extract technical data or user information.

  • System Interference: Attempting to bypass security protocols, "spamming" our inquiry forms, or injecting malicious code into the platform.

  • Commercial Misrepresentation: Using our proprietary logic to solicit third parties for competing mobile infrastructure services.

5. The Alpha Launch Reservation Protocol

  • Signal of Intent: A "Reservation" is a non-binding signal of project intent. It is not a guarantee of hardware availability or a final lease agreement.

  • Deployment Discretion: BuildPod LLC reserves the unilateral right to prioritize Alpha Launch slots based on site feasibility, geographical logistics in Southeast Michigan, and engineering requirements.

  • Rate Protection: "Founding Member" price-locks are contingent upon the execution of a formal Master Service Agreement (MSA) and are valid for 24 months from the date of the Alpha Launch.

6. Third-Party Ecosystem Disclaimer

Our Site may contain links to industrial partners (e.g., Siemens, Legend, Avi-on). BuildPod LLC does not control and is not responsible for the privacy practices or technical accuracy of third-party websites. Your interaction with these entities is at your own risk.

7. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. To the fullest extent permitted by Michigan law, BuildPod LLC disclaims all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular industrial purpose. We do not warrant that the Site will be 100% error-free or that its digital telemetry will be uninterrupted.

8. Limitation of Liability & Indemnification

  • Liability Cap: In no event shall BuildPod LLC or its officers be liable for any indirect, incidental, or consequential damages (including lost project profit or billable hours) arising from your use of the Site. Our total digital liability is capped at $100.00 USD.

  • Indemnification: You agree to defend and hold BuildPod LLC harmless from any claims, damages, or legal fees resulting from your breach of these Terms or your unauthorized use of our Proprietary Assets.

9. Governing Law & Mandatory Arbitration

  • Venue: These Terms are governed by the laws of the State of Michigan.

  • Arbitration: Any dispute that cannot be resolved through good-faith negotiation shall be settled via Binding Arbitration in Washtenaw County, Michigan, administered by the American Arbitration Association (AAA). You waive your right to a jury trial or to participate in class-action litigation.

10. Severability & Entire Agreement

If any portion of these Terms is deemed unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. These Terms, alongside our Privacy Policy, constitute the entire agreement regarding your digital interaction with BuildPod LLC.
